GENERAL TERMS AND CONDITIONS

General sales and delivery and payment conditions of International Ties and Speciale Dassen, with registered office in Doesburg, registered with registration number 09108537 at the Chamber of Commerce Arnhem, The Netherlands.

Article 1. Definitions

1.1 Special Dassen | International Ties has an online store in accessories (primarily in ties, scarves, pins and cuff-links), which can be visited via https://www.specialedassen.nl

1.2 These general terms and conditions (hereafter: conditions), belonging to the internet activities of Special Dassen, are in accordance with the General Terms and Conditions Thuiswinkel and the Gedragsregels Thuiswinkelwaarborg of the Dutch Thuiswinkel Organization. These conditions and rules of conduct can be found on the website www.thuiswinkelwaarborg.nl.

Article 2. Applicability

2.1 These General Terms and Conditions of Sale (hereinafter: Conditions) apply to all offers, orders and agreements concluded with Special Dassen at the exclusion of any other general terms and conditions.

2.2 Accepting an offer or placing an order will take place subject to acceptance of the applicability of these Terms and Conditions.

2.3 The provisions of these Conditions can only be deviated from in writing. If a part of these General Terms and Conditions is deviated from, the other provisions will remain in full force.

2.4 All rights and claims, as stipulated in these Conditions and in any further agreements for the benefit of Special Dassen, are also stipulated for the benefit of intermediaries and other third parties engaged by Speciale Dassen.

Article 3. Agreements

3.1 An agreement is concluded after acceptance of the order of a customer by Special Dassen. Special Dassen is entitled to refuse orders or to request additional information. If an order is not accepted, this will be communicated to the customer stating the reason.

3.2 If you receive a refund on grounds of the General Terms and Conditions of Specialties, you can expect the refund within 30 working days. Speciale Dassen is not liable if this period is exceeded due to force majeure or. due to errors and / or defects at third parties (eg banks and credit card companies).

Article 4. Prices

4.1 The prices mentioned in the articles are in euros, including VAT. Administration and shipping costs are (unless stated otherwise) not included in the prices mentioned.

4.2 The administration and shipping costs of orders within the Netherlands are at least € 2.00.

4.3 If you order from abroad you will receive a confirmation from us with the correct shipping costs to your country and the BIC and IBAN code.

4.4 Speciale Dassen cannot be held to price quotations that are evidently incorrect, for example as a result of obvious input, typesetting or printing errors. No rights can be derived from unlawful price information.

Article 5. Payments

5.1 Payment can take place in (one of) the manner (s) as indicated during the ordering process. Further (payment / order) conditions can be set for a customer's order. After placing an order, the customer immediately receives a confirmation by e-mail with the total costs, including administration and shipping costs. Payment always takes place entirely in advance by the customer. Payment is possible by: a) Transfer (in writing or via internet) to the bank account of Speciale Dassen| International Ties: 4339409. b) iDeal: If you bank via the internet at Rabobank, ABN AMRO or ING, you can electronically secure the payment of your order through our site. An electronic payment via the Internet can be compared to a PIN payment in a store. After placing your order, you choose the payment method iDeal. A screen opens where you can choose the bank where you bank online. You then follow the procedure you are used to with payments via internet banking. In principle, the payment is processed the same day. c) Direct and online by credit card (EuroCard / MasterCard, Visa and American Express). Your payment is then authorized online, so that you immediately know whether or not it is approved. No additional costs are charged for online payments. d) Direct and online with Paypal. 5.2 The customer authorizes Special Dassen to perform all actions necessary for payment to take place on the payment method chosen by the customer.

5.3 In case of payment by bank or giro, the date of payment is the date of crediting the giro or bank account of International Ties | Speciale Dassen.

5.4 Payment of a large order must take place within 14 days after receipt of the order confirmation, unless otherwise agreed in writing or by e-mail. After 14 days a first reminder follows. If no payment is received within 14 days after the first reminder, this order will automatically be canceled.

Article 6. Delivery

6.1 Special Dassen strives to deliver orders within 5 working days after receiving the full payment or an agreement from the bank. However, Special Ties is not obliged to this.

6.2 The delivery deadline is 10 working days after placing the order, except to the extent that the delay can not be attributed to Special Dassen.

6.3 If the delivery is either temporarily out of stock or delayed for other reasons, or if an order can not or only partially be executed, the customer will receive notice no later than seven (7) working days after placing the order. In that case, the customer has the right to cancel the order without any costs. Special Dassen will in that case take care of reimbursement.

6.4 Deviations in color, type, text and / or price changes are reserved.

6.5 If a model, sample or example has been shown or provided by Special Dassen, this is presumed to have been shown or provided by way of indication: the qualities of the goods to be delivered may General Terms and Conditions © 2018 Speciale Dassen | International Ties deviate from the sample, model or example, unless explicitly stated that the items would be delivered according to the sample, model or example shown or provided.

6.6 If the goods to be delivered are to be used outside the Netherlands, Special Dassen is not responsible for ensuring that the goods to be delivered comply with the technical requirements, standards and / or regulations imposed by laws or regulations of the country where the goods are to be used.

6.7 In terms of quotations or order confirmations from Special Dassen specified delivery times and other terms specified by Special Dassen performances are general and only informative; exceeding it does not entitle the customer to compensation or dissolution.

Article 7. Reservation of ownership

7.1 The ownership of delivered products is only transferred if the customer has paid all that the customer owes to Special Dassen on the basis of the agreement (s) concluded with respect to the delivered products.

7.2 All goods delivered by Special Dassen remain the property of Special Dassen until the customer has fulfilled all the following obligations from all purchase agreements concluded with Special Dassen.

7.3 Goods delivered by Speciale Dassen, which are subject to retention of title pursuant to paragraph 1, may only be sold on within the framework of normal business operations and may never be used as a means of payment.

7.4 The customer is not authorized to pledge the goods falling under the retention of title or to encumber them in any other way.

7.5 The Customer already gives unconditional and irrevocable consent to Special Dassen or to a third party designated by it to, in all cases in which Special Dassen wants to exercise its property rights, to enter all those places where the properties of Speciale Dassen will be located and to take those things there.

7.6 If third parties seize goods delivered under retention of title or wish to establish or assert rights thereon, the customer is obliged to notify Special Dassen as soon as reasonably may be expected.

7.7 The customer undertakes to insure the goods delivered under retention of title and to keep them insured against fire, explosion and water damage as well as against theft and to make the policy of this insurance available for inspection on first request.

Article 8. Return of articles

We do everything we can to inform you correctly about the articles. If an item nevertheless does not meet your expectations, it can be sent back. However, the customer is obliged to return the article at his own expense. A number of conditions apply to returns:

8.1 Items that you have purchased via www.specialedassen.nl can be returned. Returning is possible within 14 days after delivery of the order, provided that the following points are met; General Terms and Conditions © 2018 Speciale Dassen | International Ties

* A return shipment must be notified to Special Dassen | International Ties in advance, stating the order number, in writing or by email (info@specialedassen.nl)

* The item to be returned must be sent together with a fully completed return form to Speciale Dassen, Campstede 13, 6983 HJ, Doesburg. The return form can be downloaded in PDF format on the website or sent by e-mail on request.

* Not registered return shipments, and return shipments that do not have a return form will not be processed. * Postage costs and shipping risk of a return shipment will be charged to the customer.

* An insufficiently stamped return is not accepted.

* The returned article must be received unworn, undamaged and in the original packaging by us.

* In the event of a return shipment, the purchase price, less the administration and shipping costs, will be refunded within 30 days

8.2 Special Dassen accepts only returns as described above and for which the instructions indicated at registration have been followed. Returns that are not or not registered within the stipulated time will not be accepted.

8.3 Right of withdrawal for private consumers You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of purchase. In order to exercise the right of withdrawal, you must provide us with an unequivocal statement (eg. in writing by post, fax or e-mail) of your decision to revoke the agreement. In order to comply with the withdrawal period, it is sufficient to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the cancellation If you revoke the contract, you will receive all payments you have made up to that moment, including delivery costs (with the exception of any additional costs resulting from your choice for a different method of delivery than the cheapest standard delivery that we offer). in any case not later than 14 days after we have been informed of your decision to with

draw from the contract, from us back. We will pay you back with the same payment method with which you made the original transaction, unless you have expressly agreed otherwise; in any case, you will not be charged for such reimbursement.

Article 9.Orders / communication

For misunderstanding, mutilation, delays or inadequate delivery of orders and announcements as a result of the use of the Internet or any other means of communication in the traffic between the customer and Special Dassen, or between Speciale Dassen and third parties, insofar as they relate to the relationship between the customer and Special Dassen, Special Dassen is not liable, unless and insofar as there is intent or gross negligence of Special Dassen

Article 10. Guarantees

10.1 Special Dassen guarantees that the delivered products comply with the agreement and meet the specifications stated in the offer, and is therefore responsible for the factory warranty of the product delivered to you.

10.3 Warranty expires if other than the manufacturer / repair services other than the expertly designated service / repair services have carried out repair or other work on the product.

10.4 Warranty means that Special Dassen is committed to 1. to bear the costs of repair and repair work, 2. to be able to replace the product with an equivalent product and, if this is not reasonable, 3. refund of the purchase price.

10.5 The Customer can not derive any right to the guarantee provisions referred to in this article, before full payment, in accordance with the invoice of Special Dassen, of the delivered goods has taken place.

Article 11.Force majeure

In case of force majeure, Special Dassen has the right to suspend, at its own option, the execution of the order of a customer, or to dissolve the agreement without judicial intervention, such by communicating this to the customer in writing and without that Special Dassen is obliged to pay any compensation, unless this would be unacceptable in the given circumstances by standards of reasonableness and fairness.

Article 12. Applicable law and competent court

12.1 Dutch law applies exclusively to all rights, obligations, offers, orders and agreements to which these Terms and Conditions apply, as well as to these Terms and Conditions.

12.2 If by judicial decision one or more articles of these conditions are declared invalid:

• other provisions of these terms and conditions will remain in full force and effect,

• Special Dassen and the Client will consult with each other in order to agree on new provisions to replace the void or voided provisions, whereby the purpose and purport of the void or nullified provisions will be taken into account as far as possible.

12.3 Only Dutch law applies to the agreement. 12.4 All disputes between parties will exclusively be submitted to the competent judge in Arnhem, The Netherlands.
